Privacy Policy & Data Deletion Policy

FSMS built the FSMS – Send SMS to Philippines app as an Ad Supported app. This SERVICE is provided by FSMS at no cost and is intended for use as is.

This Privacy Policy explains how we collect, use, store, disclose, and safeguard information in compliance with the Data Privacy Act of 2012 (RA 10173) and Google Play requirements.

1. Gathering of your personal information

FSMS  – Send SMS to Philippines may collect information about your visit to our web site and use of our  FSMS - Send SMS to Philippines messaging application, including the pages you view, the links you click and other actions taken in connection with the service. We also collect certain standard information such as your IP address, browser type, language and geographical location.

Permissions needed for this app to work:

• CONTACTS -  Required to identify incoming messages and select contacts to send your message.

• PHONE NUMBERS - Required to completely process incoming and outgoing sms. A standard SMS to complete the message should have a recipient and a sender. Our system doesn't save any phone numbers in the database. Upon sending, the message is sent to the target phone number and delete immediately after processing.

• PHONE STATUS - Required for the app to identify the device for operation and manages some background services.

• READ PHONE  STATE - Allows read only access to phone state, including the current cellular network information, the status of any ongoing calls. To present the user with alternative options when placing a phone call  

•  READ/WRITE MESSAGES - Required to send, write, receive messages.

• INTERNET - Required  for the app to send and receive online messages via our SMS servers. FSMS securely uploads outgoing and incoming SMS information to our own managed SMS server if you send via FSMS/Online. 

The collected data are temporarily collected and will be removed immediately after processing. All messages sent and received directly through your SIM card are not included.

2. Survey Serving Technology 

This app uses Pollfish SDK for surveys. Pollfish may collect limited device information (such as advertising ID) if you have interest-based ads enabled. You can opt out by disabling interest-based advertising in your device settings or through Pollfish’s opt-out page.

Apple, Google, and Amazon are not sponsors and are not involved in any way in survey draws.

3. Information Collection and Use 

For a better experience, while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to Internet protocol (IP), Advertising ID, Location, Device ID, Browser Type, Geographical Location. The information that we request will be retained by us and used as described in this privacy policy. The app does use third party services that may collect information used to identify you. 6. Firebase Authentication - When you sign in using Firebase Authentication, we may collect:

• Email address (if you sign in with Google or email)

• Name (from your Google profile, if available)

• Unique identifiers (Firebase user ID)

• Phone number (if you sign in with phone number)

We do not collect other personal data such as addresses, photos, or location unless explicitly provided by you.

4. Log Data 

In case of an error, we collect Log Data (through third-party products) such as IP address, device name, operating system version, app configuration, time/date of use, and usage statistics.

5. Security 

We value your trust in providing us your Personal Information, and we use commercially acceptable means to protect it. However, no method of transmission over the Internet or electronic storage is 100% secure.

6. Links to Other Sites 

This Service may contain links to other sites. Clicking on a third-party link will redirect you to that site, which is not operated by us. We strongly advise you to review the Privacy Policy of any external websites.

7. Service Providers 

We may employ third-party companies and individuals due to the following reasons: 

• To facilitate our Service;

• To provide the Service on our behalf;

• To perform Service-related services;

• Or To assist us in analyzing how our Service is used.

These third parties may have access to your Personal Information but are obligated not to disclose or use it for any other purpose.

8. Data Retention and Deletion Policy

We retain your personal information only as long as your account is active or as necessary to provide the Service.

Full Account Deletion:

• You may request deletion of your account and all associated data at any time.

• To do so, you can:

  • Use the “Delete Account” option in the app (if available), or

  • Email us at [email protected] with the subject line “Delete My Account.”

• Once a verified request is received, we will permanently delete your account data from our systems and from Firebase within 30 days.
  
  

Selective Data Deletion:
If you do not wish to delete your entire account, you may contact us to request deletion of specific types of personal data, such as:

• Email address

• Phone number

• Name from your Google profile

• Firebase user ID

• Analytics or advertising identifiers
  
  

We will process such requests promptly and confirm once the data has been removed, unless retention is required by law or for legitimate business purposes (e.g., fraud prevention, dispute resolution).

Data Retained for Legal or Security Purposes:
Some data may be retained for a limited time where required:

• Log data (such as IP address and crash reports) may be stored temporarily for security and troubleshooting.

• Transactional SMS data processed by our servers is deleted immediately after successful delivery.

9. Acceptable Use Policy (AUP) – PROHIBITED BEHAVIOR

Users must not use the FSMS app or SMS relay service to:

• Send threats, harassment, hate speech, or abusive messages

• Send death threats or any message constituting a criminal offense

• Engage in fraud, phishing, scams, or impersonation

• Send bulk spam or unsolicited messages

• Violate local laws such as the Cybercrime Prevention Act, RA 11934, or the Revised Penal Code

• Conceal identity or attempt to spoof phone numbers

• Use the service for any illegal or harmful purpose
  
  

Violations may result in immediate account suspension, blocking of access, or reporting to authorities.

10. Misuse Prevention Clause

FSMS is designed as a lawful communication platform. To protect users and the public, FSMS implements measures to detect and prevent system abuse, including limited temporary logging for security and troubleshooting.

FSMS does not create, author, or initiate any user-submitted messages. All message content is provided entirely by the user.

In cases of misuse—such as harassment, impersonation, threats, fraud, or any activity that violates Philippine law—FSMS may restrict access to the Service and cooperate with law enforcement by providing available technical information as required by law.

11. User Responsibility and Liability

All messages sent through the FSMS app—whether through SIM or online relay—are the sole responsibility of the user who sends them.

By using the Service, you agree that:

• You are fully responsible for any content you transmit.

• FSMS does not edit or alter your message content.
  However, the system may automatically append service-related information
  (such as the sender name or “via FSMS”) for identification and delivery purposes.

• FSMS is not liable for abusive, illegal, fraudulent, or harmful messages sent by users.

• You may be held legally and criminally responsible for threats, harassment, fraud, impersonation, or any unlawful activity committed through the Service.

12. Developer Non-Liability Statement

FSMS and its developer:

• Are not responsible for any illegal or harmful messages sent by users

• Cannot be held liable for the intent or actions of those who use the service

• Do not author or initiate messages

• Only transmit messages submitted by users
  
  

FSMS acts only as a technical platform. We do not monitor, moderate, or control the specific content users choose to send.

13. Cooperation with Law Enforcement

FSMS may disclose limited information (such as logs or identifiers) when required by law, or upon valid request from law enforcement authorities, courts, or regulatory bodies for the investigation of criminal activity.

This includes cases involving:

• Threats or harassment

• Fraud or cybercrime

• SIM misuse

• Any violation of Philippine law
  
  

Only the minimum necessary data will be shared.

14. LEGAL Disclaimer 

We may disclose personal information when required by law, such as to comply with a court order, subpoena, or legal process. We may also share information to respond to law enforcement requests or to protect the rights, property, or safety of FSMS – Send SMS to Philippines and its users.

15. Your Acceptance of this Policy 

By using FSMS – Send SMS to Philippines, you acknowledge and agree to the terms of this Privacy Policy. Your continued use of the Service after any changes means you accept the updated terms.
